Overview

This website and online store are operated by PEKTECH Information Technologies CC, referred to in these Terms as “PEKTECH,” “we,” “us” or “our.”

By visiting our website, purchasing a product or using any part of our online store, you agree to these Terms of Service. These Terms apply to all visitors, customers and other users of the website.

Please read these Terms carefully before using our website. If you do not agree to them, you should not use the website or place an order.

Our Returns and Refund Policy, Shipping Policy and Privacy Policy form part of these Terms of Service.

1. Online store eligibility

By using this website, you confirm that you are legally capable of entering into a binding agreement or that you have permission from a parent or legal guardian.

You may not use our products, services or website for any unlawful or unauthorised purpose.

2. Product information

We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability information are accurate.

Product images are provided for illustration and may differ slightly from the supplied product because of manufacturer updates, regional variations, packaging changes or screen-display settings.

Specifications may be changed by the manufacturer without notice. Customers should contact PEKTECH before ordering if a particular specification, feature or compatibility requirement is essential.

We reserve the right to correct errors, inaccuracies or omissions and to update product information without prior notice.

3. Product availability

Products are displayed using the following availability statuses:

In stock: The product is available immediately from our local PEKTECH stock, subject to final stock verification.

Available on order: The product is sourced from our supplier in South Africa. Supplier orders are generally placed once a month. Once received by PEKTECH, the product will be delivered or shipped to the customer.

Stock quantities and supplier availability can change without notice. Adding a product to a shopping cart does not reserve that product.

If a product becomes unavailable after an order is placed, we will contact the customer. The customer may choose an alternative product or receive a refund for the unavailable item.

4. Available-on-order products

Products marked “Available on order” are specially sourced after a customer places an order.

An available-on-order product may be cancelled for a full refund before PEKTECH submits the order to its South African supplier.

Once the supplier order has been submitted, the order cannot normally be cancelled, changed or returned because of a change of mind. Cancellation after submission is subject to supplier approval and any non-refundable supplier, transport, payment-processing or administrative costs already incurred.

Estimated arrival dates are provided in good faith but are not guaranteed. Delays may occur because of supplier availability, transport, customs clearance or circumstances beyond our reasonable control.

These conditions do not affect the customer’s rights if a product is damaged, defective, incorrectly supplied or materially different from its description.

5. Prices

Unless stated otherwise, all prices are displayed in Namibian dollars.

Prices, discounts and promotions may change without notice. A price change will not affect an order that has already been accepted and paid for, except where an obvious pricing or system error has occurred.

Shipping or other applicable charges will be displayed during checkout before payment is completed.

If a product is listed at an obviously incorrect price, we may cancel the affected order and issue a full refund.

6. Orders

Submitting an order does not automatically mean that it has been accepted.

We reserve the right to accept, reject or cancel an order for reasons including:

• Product or supplier unavailability

• Incorrect pricing or product information

• Suspected fraud or unauthorised payment

• Incomplete customer or delivery information

• Restrictions imposed by a supplier or manufacturer

• An inability to deliver to the supplied address

An order is considered accepted once payment has been successfully received and PEKTECH has confirmed that the order can be fulfilled.

If we cancel a paid order, the affected amount will be refunded using the original payment method where possible.

7. Customer information

Customers must provide complete, current and accurate billing, delivery and contact information.

PEKTECH is not responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information supplied by the customer.

Customers must notify us as soon as possible if any order information needs to be corrected. Changes may not be possible after an order has been dispatched or submitted to a supplier.

8. Payment

Orders must be paid using one of the payment methods available at checkout.

The customer confirms that they are authorised to use the selected payment method.

An order will not be processed until payment has been successfully received and verified. We may request additional information to verify a payment or protect against fraudulent transactions.

9. Shipping and delivery

Orders are shipped using Formula Couriers, subject to service availability for the delivery destination.

Shipping charges are displayed during checkout. Delivery estimates begin once an order has been dispatched and do not include processing time or the time required to source available-on-order products.

Courier delivery times are estimates and are not guaranteed. PEKTECH is not responsible for reasonable delays caused by the courier, weather, road conditions, customs, remote locations or circumstances outside our control.

Customers must inspect delivered parcels and report damaged, missing or incorrect items within 48 hours of delivery.

10. Returns and refunds

Returns, cancellations, warranty claims and refunds are managed according to our Returns and Refund Policy.

In-stock products may qualify for a change-of-mind return within 7 calendar days after delivery or collection, provided they meet the conditions stated in that policy.

Available-on-order products cannot normally be returned for a change of mind after the supplier order has been submitted.

Nothing in these Terms is intended to exclude any legal rights available to customers under applicable Namibian law.

11. Product installation and compatibility

Customers are responsible for confirming that a product is suitable and compatible with their intended application before ordering.

Certain products may require professional installation, configuration, additional equipment, software, licences, subscriptions or compatible network infrastructure. These are not included unless specifically stated in the product listing or quotation.

PEKTECH is not responsible for faults, damage or poor performance resulting from:

• Incorrect installation or configuration

• Incompatible equipment, software or power supplies

• Unauthorised modifications or repairs

• Misuse, neglect or failure to follow manufacturer instructions

• Inadequate network coverage or internet connectivity

• Third-party services, platforms or subscriptions

Customers should contact PEKTECH before purchasing if they require installation, configuration or compatibility assistance.

12. Manufacturer warranties

Products may carry a manufacturer or supplier warranty. The applicable warranty period and conditions depend on the specific product and manufacturer.

Warranty claims may require inspection, testing or shipment to an authorised distributor or service centre, including a service centre in South Africa.

Warranty coverage does not generally include accidental damage, lightning or surge damage, water damage, misuse, incorrect installation, unauthorised repairs, normal wear and tear or removed serial numbers.

13. Third-party services and links

Our website may contain links to third-party websites, platforms, payment providers, courier services or manufacturer resources.

These third parties operate independently from PEKTECH. We do not control and are not responsible for their content, availability, security, policies or services.

Customers should review the applicable third-party terms before using those services.

14. Intellectual property

All website content belonging to PEKTECH, including text, graphics, branding, logos, designs and original images, is protected by applicable intellectual-property laws.

Manufacturer names, logos, product images and trademarks remain the property of their respective owners.

Website content may not be copied, reproduced, republished, sold or commercially exploited without written permission from the relevant rights holder.

15. Prohibited use

You may not use this website:

• For unlawful or fraudulent activities

• To submit false or misleading information

• To interfere with the security or operation of the website

• To introduce malware, viruses or harmful code

• To collect information about other users without permission

• To attempt unauthorised access to any system or account

• To infringe the intellectual-property or privacy rights of another party

• To place fraudulent, abusive or intentionally disruptive orders

We may restrict or terminate access where these Terms are violated.

16. Limitation of liability

To the extent permitted by applicable law, PEKTECH will not be liable for indirect, incidental or consequential losses arising from the use of this website or a product purchased through it.

This includes loss caused by third-party services, internet outages, compatibility issues, data loss or circumstances outside our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any rights and remedies available to customers under applicable Namibian law.

17. Indemnification

To the extent permitted by applicable law, you agree to compensate PEKTECH for reasonable losses, liabilities or expenses arising directly from your unlawful use of the website, your violation of these Terms or your infringement of another party’s rights.

18. Privacy

Personal information submitted through the website is handled according to our Privacy Policy.

By placing an order, you authorise us to share the information reasonably required by payment providers, Formula Couriers and other service providers to process payment and fulfil delivery.

19. Changes to these Terms

We may update these Terms of Service when necessary. The version published on this website at the time an order is placed will apply to that order.

Continued use of the website after changes are published constitutes acceptance of the updated Terms.

20. Severability

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.

21. Governing law

These Terms of Service and any transactions made through this website are governed by the laws of the Republic of Namibia.

Any dispute will be subject to the jurisdiction of the appropriate Namibian courts, unless the parties agree to another lawful dispute-resolution process.
